Protected by Writ of Amparo, Gadian must come out of hiding

Senator Rodolfo G Biazon today said that the appropriate level of authority in the AFP must be clarified with the mandate of the Supreme Court ruling granting the writ of amparo petititon on the case of Lt Sg Nancy Gadian.

"The Flag Officer in Command of the Philippine Navy must understand what this Supreme Court ruling mandates him to do."

Biazon said, "The final resolution of the Gadian case requires the FOIC to perform certain administrative functions to include a resolution of Gadian's resignation and the resolution of cases that might have been filed against Gadian in the military administrative system."

"If Gadian's resignation is approved, and she is eventually mustered out of the service, Lt Sg Gadian must come out and put herself in the appropriate process."

The Chairman of the Senate Committee on National Defense and Security said before Gadian is finally mustered out of the Philippine Navy, the following must be determined:

1. Whether or not Lt Sg Gadian has money or property accountability;

2. What are the legal benefits due to Lt Sg Gadian such as the refund of her RSBS capital contribution and commutation of leave the cumulative estimate total of which is about half a million pesos (P500,000), pay and allowances due her and other benefits from the GSIS etc.

Biazon concluded, "For these to be settled, Lt Sg Gadian must come out and still be protected under the writ of amparo granted by the Supreme Court."
