TRANSCRIPT OF INTERVIEW: DZMM - Rated Korina
Cayetano, JCOC-AES probe on 3 crown jewels of Automated Election continues;
to look into reliability of machines supplied by Smartmatic in tomorrow's hearing

Korina Sanchez (KS): Good morning, Senator.

Senator Alan Peter Cayetano (ASC): Good morning...

KS: (tungkol sa Automated Elections) Karamihan sa mga mamamayan ay hindi naiintindihan na kahit makina 'yan ay pwedeng magkamali.

ASC: Garbage in, garbage out.

KS: Director Jimenez, ang sinasabi po nila kahapon na ang Smartmatic ay nadiskubre nga na hindi siya ang totoong may-ari ng source code. Kumbaga, 'yung sistema ay hindi naman sila. Kumbaga, nag-middleman lang sila at ang talagang may hawak ng sistema ay itong Dominion. At hawak ng Dominion ang sistemang ito, hinahabla sila ngayon ng Smartmatic. Paano po ngayon kapag hindi nagkaaregluhan, ano ang sistema natin sa 2013?

Comelec Spokesperson James Jimenez (JJ): Under the terms of the license, may karapatan ang Smartmatic na gamitin 'yon at ayusin at gumawa ng kinakailangang modification.

Pangalawa, 'yung hablaan ng dalawa ay labas po tayo doon. Hindi tayo affected. 'Yung reklamo nila ay dahil para sa Smartmatic, at makikita sa court record, ang nangyari, 'yung Dominion, may dapat silang gawin, which was basically to deposit the source code sa Amerika bilang bahagi ng kanilang licensing agreement.

Dahil nagkaroon sila ng problema doon, humabla ang Smartmatic. As far as the Comelec is concerned, in fact, as far as all election systems na ka-partner ng Smartmatic all over the world is concerned, hiwalay na issue po iyon.

At kami naman sa Comelec, matagal na din naming binabantayan ang development na 'yan, and so far, wala namang nakikitang problema ang aming legal team at 'yung nag-ooversight sa issue na 'yan. In fact, ang sabi nga ng Chairman namin, this is probably in the nature of a collection feud between two parties na hindi necessarily affected 'yung Comelec bilang consumer.

KS: So sa 2013 kahit hindi pa po magka-ayusan ang Smartmatic at Dominion ay tuloy pa din po ang pag-gamit natin ng sistema.

JJ: Definitely. In fact, Ma'am, 'yung sistema na gagamitin natin for 2013 is undergoing review right now. So ibig sabihin, mayroon na tayong sistema, wala na tayong masyadong alinlangan diyan. Most of the enhancements, about 40 of them, are already being tested by what we call SLI [Global Solutions], which is an independent third party reviewer so sa atin.

Ito 'yung sistemang gagamitin natin, at matagal na nating nagawa ito and we think that 'yung elections natin ngayong 2013 are undernoted.

KS: Sen. Cayetano, would you agree na wala daw pong problema sa 2013?

ASC:

"Joint Congressional Oversight Committee on Automated Election System (JCOC-AES) will have a hearing tomorrow to look into the machines to ensure that we will not go back to manual"

Good morning, Director. Korina, rewind lang ako nang kaunti. From the start, ang sinabi ko, after the successful 2010 election, hindi perpekto ang mga machines at may kailangang i-audit at maraming kailangang tingnan. Having said that, maraming mga sindikato na nawalan ng trabaho ang gusto na bumalik tayo sa tinatawag na manual election.

Ang nangyayari po ngayon, nagsimula tayo last week sa joint oversight committee ng kongreso, tatlo po ang tinatawag kong three crown jewels ng automation na kailangang tingnan--'yung transmission, ballot printing, at 'yung machines.

So far, doon sa aming mga hearings, may natuklasan na nga na overpricing. Dito sa Smartmatic na sa kanila ang warehouse, naibaba na ng Comelec after three times kami na nag-hearing. From P11 million a month ang presyo ng warehouse, ngayon, P6 million na lang. And then naging problema 'yung sa transmission.

Tatlo kasi 'yan. 'Yung galing sa PCOS machines, para makakasiguro lahat na tama ang bilang sa resulta, ipapadala 'yan, una, sa tinatawag na ladderized--municipal tapos sa provincial, pagkatapos ay sa national. 'Pangalawa ay sa Comelec, at pangatlo sa KBP at mga partido. Noong una, tinanggal ng Comelec ang sa partido at sa KBP. Pero nagpapasalamat naman ako na after four hearings, ibabalik na daw nila sa tatlo para makasiguro na mababantayan 'yan.

Tamang-tama ang show mo at ang topic mo kasi bukas ng umaga, ang topic namin bukod sa printing ng balota at security ng balota, kasi nangangamba kami na magkakaroon nanaman ng extra na balota na maimprenta at maideliver sa gustong magbenta ng balota, 'yung makina at ang away ng Smartmatic at Dominion, 'yun po ang isasalang namin na topic bukas.

Nagpapasalamat din ako sa mga congressmen dahil kumpleto din sila na nag-attend dito.

Ibig sabihin, I'd rather be an alarmist at this point in time in the sense that tingnan nating mabuti kung totoo. Na walang problema. Remember na noong last election, one week before the election tinest ang makina at ang daming naging problema. Even after the election, may mga sinasabing hindi nabasa, sobra ang shading, o hindi na-save nang mabuti, those are issues that are still unresolved in some cases.

So if the Comelec is saying they are on track, pwede naman akong maniwala doon pero I'd rather still have the oversight hearing and lahat ng issues ay lumabas kasi tama ang sinabi mo na ang makina pwedeng dayain 'yan. At kung noong 2010 ay may nakapag-figure out at hindi natin nabuko o kung hindi nadaya 'yan, paano kung may nakapag-figure out ngayong 2013?

It's important that we test the machines and we get any and every technical group and election watchdog to be able to look at the system. Bukas po, that will be an open hearing at 'yon pong grupong mga tinitingnan ang makina are welcome to be there.

KS: ...Maliban po doon sa mga nangyari noong 2010, paano nga naman kung mangyari ulit ngayong 2013, ano po?

ASC:

On the Smartmatic Contract: "How can one guarantee a software that it does not own?"

Tama 'yon. At wala naman kasing mawawala kung sumobra ang higpit natin. And remember, iba ang automation ng 2010 sa automation ng 2013. Noong 2010, isa lang ang contractor. Smartmatic lang. Kaya kung may sisisihin ka, Smartmatic lang.

Ngayon in-unbundle ng Comelec. Ibig sabihin, iba-iba ang kontrata. And so far, lahat ng iba-iba nilang kontrata, walang naging successful bidding. Lahat may failure. Isa lang ang nag-succeed ang bid, may problema pa. Ito po 'yung pinasa nila sa NPO.

Halimbawa, ngayon, ang magde-deliver ng mga balota ay mga taga-Comelec. Hindi ang contractor. Ang magpi-print ay taga-NPO at contractor nila. Iba din ang supplier ng makina and we found out now na hindi naman pala sila ang manufacturer o owner ng software. 'Yon pala may license agreement lang din sila. Ang under the contract, they guaranteed the software. How can you guarantee a software na hindi naman ikaw ang may-ari?

KS (To Jimenez): So there is no doubt in your mind na ang ginawa ng Smartmatic ay legitimate, na ang ginawa kahit ang source code o sistema ay hindi sa kanila? Tama po ba kapag ikaw ay magbi-bid sa ganyan pwede na parang middleman ka lamang?

JJ: Hindi naman din sila parang middleman dahil 'yung license ay comprehensive naman. Ni-review naman po 'yan ng maraming tao at hindi lamang ng Comelec. If you remember, ang haba-haba ng bidding process noon. So lahat ng issues na 'yan, na-interpret na dati 'yan.

And that never raised any concern dahil sa tingin namin, 'yung license na hawak nila was comprehensive enough to allow them to make any changes necessary. And in fact, iyon po ang nangyari. Immediately after the elections, 'yung binabanggit ni Sen. Cayetano na naging concerns ay ni-raise na din namin.

And when we were preparing for the 2011 ARMM elections, pinasok na po namin ang mga corrections and enhancements. Unfortunately, hindi natuloy ang ARMM elections. But definitely, 'yung corrections at ang pagpapabuti ng sistema ay naipasok na anatin. We haven't had a problem with that.

Ang now, if you read the complaint, it is really an internal problem between Dominion and Smartmatic and in no way na threatened ang security ng ating election.

KS: Sen. Cayetano, agree po kayo na parang kahit hindi naman talaga ito ang grupo na may-ari o gumawa ng sistema, tama po ba na mayroong ganoong klaseng arrangement?

ASC:

"We owe it to the people that we have a fair, credible, and clean election - both in terms of perception and practice"

Yung pamilya ni Justice Castillo at 'yung foundation nila ay nagkaroon ng forum last Friday sa Ateneo at in-explain ni Atty. Bong Bernas 'yan na noong binid-out kasi, when you bid out kasi, iba ang may-ari ng hardware sa may-ari ng software, and then someone could instigate.

But under the Terms of Reference for 2010, ang gusto nila, sila ang may-ari ng sistema, pero hindi pala. So what happened, actually, is that Smartmatic made a contract with their software supplier and then guaranteed the effectiveness of the software in behalf of the supplier.

In normal cases, it is usually the owner that guarantees.

Having said that, para na akong "between the devil and the deep blue sea" kasi kung babalewalain ang mga makina ngayon, babalik tayo sa manual. Pero kung sasabihin mo naman na gagamitin ang mga machines at may questions naman, there won't be a perception that we will have a fair and honest ang election without any problems to be encountered with these machines in 2013.

That's why we're having the JCOC tomorrow and that's why we're letting them all explain. Kung anumang adjustment ang pwede pang gawin, ay magawa na. Parati kong ine-emphasize kay Chairman Brillantes, even if in reality the elections will be fair, it is important that the perception that Comelec shows is also fair and consistent with reality. And vice versa.

Salamat na binabantayan ninyo ang issue na ito. We will make sure na hindi lamang in reality na fair kung hindi 'yung perception na din. We shall try to seek more safeguards in the system to ensure credible and clean elections.

Paanong randomly ay ma-test ang machines? paano na mababantayan na walang dayaan sa bawat lugar? Yes, it is a logistical nightmare but I think we owe it to the people to guarantee a fair, credible, and clean elections in 2013 especially after the problems that were encountered in 2010 and the past.
