Senate amends probation law

The Senate today passed on third and final reading a bill which seeks to expand the benefit of probation under the country's probation law for more eligible convicts, to make it more inclusive and reflective of the rehabilitative stance of the nation's justice system.

"The measure allows a defendant to be admitted into probation despite having previously appealed his or her conviction, even if the appealed decision would later impose a probationable penalty," Senator Aquilino "Koko" Pimentel III, sponsor of Senate Bill No. 2280, an Act amending Presidential Decree No. 968, otherwise known as the Probation Law of 1976, as amended, said.

Senate President Franklin M. Drilon said that the measure is part of the Senate's continuing efforts to improve the country's justice system: "The passage of SBN 2280 can help better our country's laws regarding probation, and stay true to its goal of helping the accused reform and rehabilitate themselves into law-abiding individuals without the stigma of a prison record."
