Ambush Interview | RE law, FIT, Conflict between NGCP & TRANSCO

SEN WIN: That enacted comprehensive RE (Renewable Energy) law, almost 10 years na tayo diyan. We're the biggest department circular on their policy of FIT (Feed-In Tariff). Kasi kung wala nang FIT, give us something in writing. Anong details nito? Ayaw naman natin pag gising ni Secretary bukas, balik na naman sa dati. We really need to have a department order in writing, parang industriya, pag walang FIT, edi o sige walang FIT at least there's certainty in the industry. how long will it be? Kapag mataas pa yung presyo ng technology? or until pag bumaba na? Things like these.

Q: Is it going to work around the law and then 2018 baka may digression, might be another round of FIT?

SEN WIN: What's important here is certainty, attracting investors. Proponents are bringing in money from the outside, these guys cannot move eh, so they really need certainty and all the members of the commission agreed na lahat talaga dapat meron definitive. It cannot be a verbal policy it has to be a written policy. That's another one, the big debate on the FIT 2017 application and we heard this from Commissioner Aina, is that on September magkakaroon na ng resolution on that. I don't want to talk about how much but importante certainty. We have contractual agreements with the proponents and meron silang contractual agreements with their funders and in the over-all scale of things, we're attracting investors. If we cannot fulfill one contractual agreement in the power sector, how can we attract in other sectors?

Q: JCPC will take charge a third party investigation, yung conflict ng NGCP and TRANSCO on broadband?

SEN WIN: TRANCSO is going to request? Ako I'm open to that if they are going to request it with writing and details. Of course we will have a preliminary conference weather there is merit for the Commission to look at this. Definitely the role of the Commission is oversight and weather the law is being implemented or violated. Now the oversight will recommend changes in the law if need be.

Q: Meron din daw losses ang pre-payment ng NGCP. Recommendation daw of the President is to file charges against them? Will you step into that?

SEN WIN: I want to study that very carefully before I can make any comment. Definitely in the interpretation of the law, we want to take a prudent step. To continue on that line of thinking, ako, okay ako if it will be thrown to JCPC because that's the power of the JCPC, oversight of the laws.

Q: Definitive policy preposition on the stranded solar? Yung 300 megawatts? Or is up to the DOE and NREB?

SEN WIN: Ako, with the policy right now of no FIT, they took the risk, they knew the rules and I think they have to bear the risks.
