Transcript of Sen. Bam's questions during hearing on Marcos' reinstatement
(Part 2)

Sen. Bam: Before I ask Atty. Treambulo, I would like to echo what our chairman said to commend our state prosecutors. Alam kong hindi madali ang ginagawa niyo. I can only guess that you're under a lot of pressure pero andito po kayo standing by your information and standing by what you think is right and that is your job, doing the right thing sa inyong trabaho. My hats off to you kasi hindi madali ang ginagawa ninyo. NBI rin, Director Guerrran alam ko hindi ito madali. I know that you will keep your professionalism.

Dir. Guerran: Thank you pero wala pong pressure sa amin.

Sen. Bam: That's good to know. Sometimes kasi ang pressure, kahit walang nagsasabi nararamdaman mo pa rin. Kahit walang bumubulong nararamdaman mo pa rin. In any case, I admire your standing your ground on this matter. Let me ask Atty. Treambulo, kanina po tinanong kayo ni Sen. Poe if you stand by your recommendation na mayroong murder na nangyari and you said yes. Tatanungin ko lang po, kung sa tingin niyo po muder, bakit ang rekomendasyon niyo na penalty naging suspension. Hindi ho ba na kapag may findings ang IAS na murder and that's a capital, the recommendation administratively should be dismissal. Hindi ba ganon ang pangkaraniwang rekomendasyon.

Atty. Treambulo: We are governed by the Napolcom circular. Those charges na grave misconduct, grave neglect of duty dismissal po ang kanyang penalty because that is grave. However, in the same circular, there are circumstances na affecting po ang liability ng penalty na dismissal, iyong tinatawag nating mitigating at aggravating circumstances. In this case, the respondent presented their awards, commendations etc. which under the Napolcom circular ay puwedeng magamit na mitigating circumstances. Dapat ang kanilang penalty ayon sa Napolcom circular which is 60 days to 180 days pero kung mayroong aggravating, offset then kung ang penalty diyan ay medium, which is demotion in rank. Here hindi po natin tinitingnan ang murder dahil criminal po iyon. Kasi kung may illegal acts na committed ang empleyado, ang tinitingnan natin sa PNP ay ang kanyang asta bilang isang empleyado pero ang kanyang violation sa penal code which is murder, iyon ay jurisdiction ng korte at parurusahan siya ng penalty provided by the revised penalty code. Then doon sa biktima na isang aggrieved party ay ang pag-violate ng certain rights at iyon ang pagkuha ng kanyang life. Sa amin po, iyon ang tinitingnan, dito pinipilit naming makahanap ng aggravated circumstances which is not alleged in the complaint. Pero dahil iyong aming prosecution ay china-charge siya same bilang prosecution ng kriminal, although grave misconduct lang, nila-lumpsum lang, iyon ang aming ginagamit bilang aggravating because it is also provided in the Napolcom circular na kung mayroong other counts, iyong isa ang gagamitin mo with the higher penalty bilang kaparusahan and the other should constitute bilang aggravating. So sa conspiracy dalawa po ang patay doon so iyon ang ginagamit naming aggravating circumstance kaya napunta sa medium which is demotion in rank.

Sen. Bam: Ano ang scale ng penalties sa administrative. Ano ang pinakamababa, reprimand?

Atty. Treambulo: Pag light offenses, kung simple misconduct, that is admonition, reprimand, suspension to 30 days. Less grave, iyon po iyong 31 days to 59 days. The next is 60 days to dismissal from the service.

Sen. Bam: So 60 days to dismissal is the highest offense. Ang sinasabi niyo, pasok ang four months suspension sa highest offense, is that right.

Atty. Treambulo: Kung ang findings namin ay command responsibility, under the Napolcom circular, simple neglect of duty lang kasi wala siyang ginagawa sa pag-violate, sa pagpatay ng mga inmate....

Sen. Bam: So neglect of duty lang iyong kay Supt. Marcos? But I thought earlier na you agreed with Sen. Poe na murder ang nangyari.

Atty. Treambulo: In so far as the CIDG sa loob sir.

Sen. Bam: Iba ang determination mo for the PNP inside at iba kay Supt. Marcos.

Atty. Treambulo: Opo sir. There must be agreement at wala kaming nakitang direct evidence na nag-agree sila beforehand to kill Mayor Espinosa and Yap.

Sen. Bam: It is in our report na nag-meeting sila at 6 pm the day before. Nasa report ho namin iyon. You didn't recognize that as agreement na nag-usap-usap, may plano, pumunta roon, pinalabas ang guard, pinatay ang CCTV. Sa tingin mo, the rest of the PNP did it by themselves na hindi alam ni Supt. Marcos. Iyon ba ang sinasabi mo?

Atty. Treambulo: Iyong conspiracy sir, under the jurisprudence ng Supreme Court, kailangan pong i-prove ng crime itself, like dito iyong sinabi nating murder. Kailangang may agreement to kill...

Sen. Bam: But agreement is not only verbal. Agreement can be exhibited through acts, is that correct prosecutor? The lawyers behind me are saying it's correct. So sa tingin ko iyong act na nag-meeting sila, sabay-sabay dumating, pinalabas ang mga guwardiya, that's not enough to show na kasama siya sa mga nangyari? Ang hinahanap niyo ba MOA? Ano ba ang hinahanap mo?
