Gatchalian lauds Indigenous Peoples' compliance on EVOSS law

After two years since the Energy Virtual One-Stop Shop (EVOSS) was signed into law, Senator Win Gatchalian lauded the move of the National Commission on Indigenous Peoples (NCIP) to comply with the provisions of the law in pursuing energy development projects.

By virtue of a Commission En Banc Resolution, the NCIP has finally approved and will adopt an EVOSS-compliant time frame for Certificate of Non-Overlap (CNO) and Certification Precondition (CP).

Actions on applications with the NCIP shall be released within 10 calendar days in the case of a Certificate of Non-Overlap (CNO) and 105 calendar days for the Free and Prior Informed Consent (FPIC) for the issuance of a Certification Precondition (CP). A CNO is issued if the land involved in an energy project does not overlap an ancestral domain (AD) while CP is issued when the land involved is within AD and the concerned Indigenous Cultural Communities (ICCs).

The EVOSS law, which establishes an online process of completing requirements of energy-related projects, ensures that the permitting processes for power generation, transmission, and distribution in the country will remain unimpeded and will eliminate red tape while the country remains in quarantine.

"The approval process of energy projects in areas affected by IP issues usually takes years. But with their compliance with the streamlining processes of power generation, transmission and distribution projects mandated by EVOSS, investors can now be assured of a specific timeframe within which applications will be acted upon without compromising the rights of the IPs," Gatchalian said.

All government offices, including government-owned and controlled corporations (GOCCs) involved in the processing of necessary permits are likewise required to follow a strict time frame and failure of an agency to act within the prescribed period will result in the automatic approval of an application while potential administrative sanctions may be imposed against inefficient public officers to penalize the delay.

Pagtupad ng Indigenous Peoples sa EVOSS law kasado na - Gatchalian

Ikinalugod ni Senador Win Gatchalian ang pagtupad ng National Commission on Indigenous Peoples (NCIP) sa mga probisyon ng Energy Virtual One-Stop Shop (EVOSS), dalawang taon matapos itong maging isang ganap na batas, at pasinayaan ang pagsusulong ng mga proyekto sa industriya ng enerhiya.

Sa isang Commission En Banc Resolution, inaprubahan na ng NCIP ang nakasaad na time frame sa paglalabas ng Certificate of Non-Overlap (CNO) at Certification Precondition (CP) alinsunod sa ilalim ng EVOSS, ang batas na nagpaikli sa pagpo-proseso ng mga permit ng mga nagtataguyod ng energy projects sa bansa.

Batay sa nakasaad sa batas, ang mga aplikasyon para makakuha ng CNO ay dapat aksyunan ng NCIP sa loob ng 10 araw at 105 araw naman para sa Free and Prior Informed Consent (FPIC) na syang magiging daan para makapagpalabas ng Certification Precondition. Ang CNO ay iginagawad kung ang lupang katitirikan ng proyekto ay hindi masasakop ang ancestral domain o pagmamay-ari ng mga katutubo habang ang CP naman ay ibinibigay kung pinahihintulutan ng mga Indigenous Cultural Communities (ICCs) ang pagsusulong ng mga proyekto sa ilalim ng kanilang ancestral domain.

Ang EVOSS law ay nagtatatag ng online platform para mapadali ang pagpoproseso ng mga dokumento at makakuha ng mga kaukulang permit ng mga nagsusulong ng proyektong may kinalaman sa power generation, transmission at distribution habang patuloy ang pagpapatupad ng quarantine sa bansa at maiwasan ang red tape o korapsyon.

"Kadalasang inaabot ng ilang taon ang proseso ng pag-aapruba ng mga energy projects sa mga lugar na nasasakupan ng mga IPs. Ngunit ngayon na sila'y tutupad sa abisong panahon na nakasaad sa EVOSS, makakaasa tayong maisasaayos ng pagpo-proseso ng mga aplikasyon ng mga namumuhunan sa power generation, transmission at distribution projects sa bansa ng hindi nakokompromiso ang mga karapatan at kasarinlan ng mga katutubo nating kababayan," ani Gatchalian.

"Malaki ang maitutulong ng EVOSS Law upang tuloy-tuloy pa rin ang pagproseso ng mga energy-related permits dahil ang lahat ng ito ay pwede nang gawin sa online lalo na ngayong panahon ng pandemya," dagdag pa ng senador.

Sa ilalim ng nasabing batas, lahat ng ahensya ng gobyerno, pati na ang mga government-owned and controlled corporations (GOCCs) na may kinalaman sa pagpoproseso ng mga kinakailangang permit ay kailangang aksyunan ang mga aplikasyon batay sa nakasaad na time frame at ang hindi pagtugon dito ay nangangahulugan ng automatic approval at may kaakibat na posibleng parusang administratibo.
