Exempt teachers' election honoraria from tax - Gatchalian

With roughly a month to go before the end of registration for the 2022 polls, Senator Win Gatchalian pushes anew for the tax exemption of teachers' election honoraria.

In 2019, Gatchalian filed Senate Bill No.1193, which seeks to seeks to exclude from gross income and exempt from taxation the honoraria, travel allowance, and other benefits granted by the Commission on Elections (COMELEC) to teachers and poll workers under Republic Act No. 10756 or the Election Service Reform Act (ESRA). In the past elections, a 5% tax was imposed on teachers' election honoraria and allowances.

Even should teachers and poll workers receive more pay for their election day services, the Chairman of the Senate Committee on Basic Education, Arts and Culture said that giving the full amount of their honoraria, including allowances and benefits, is the the best way to thank them for their role in the upcoming elections, especially amid the continuing threat of COVID-19.

"Marami nang sakripisyo ang ating mga guro sa gitna ng pandemya bilang frontliners ng edukasyon. Sa susunod na taon, frontliners naman sila sa ating halalan. Bilang pasasalamat sa kanilang serbisyo, napapanahong 'wag nang patawan ng buwis ang kanilang mga sahod at benepisyo sa panahon ng eleksyon," said Gatchalian.

Last June, the Department of Education (DepEd) reported that COMELEC approved its proposal to give a P3,000 hike to the honoraria of teachers who will serve as Electoral Board (EB) and poll workers. Under DepEd's proposal, Chairpersons will receive Php9,000.00, Php8,000.00 will be given to EB members, Php7,000.00 for DepEd Supervisor Official (DESO), and Php5,000.00 for Support Staff.

The COMELEC, however, lamented a 37% slash in its election year budget, noting that this would affect teachers' request for an increase in their honoraria and for other benefits. The poll body said it would appeal to Congress to restore items removed by the Department of Budget and Management (DBM).

Gatchalian also pointed out that if the annual taxable income of teachers and poll workers exceeds the P250,000 threshold under the Tax Reform for Acceleration and Inclusion (TRAIN) Law, their honoraria and allowances are subject to income tax. Those who earn below P250,000 have to submit a declaration of tax exemptions.

Election honoraria ng mga guro huwag nang patawan ng buwis--Gatchalian

Isang buwan bago magwakas ang pagpaparehistro para sa halalan sa 2022, muling isinusulong ni Senador Win Gatchalian ang panukalang huwag nang patawan ng buwis ang election honoraria ng mga guro.

Noong 2019, inihain ni Gatchalian ang Senate Bill No. 1193 upang hindi na mapabilang sa gross income at hindi na mapatawan ng buwis ang honoraria, travel allowance, at iba pang benepisyong ipinagkakaloob ng Commission on Elections (COMELEC) sa mga guro at poll workers sa ilalim ng Republic Act No. 10756 o ang Election Service Reform Act (ESRA). Noong mga nagdaang eleksyon, may limang (5) porsyentong buwis na ipinataw sa election honoraria at allowances ng mga guro.

Bagama't may mga panukala ring taasan ang bayad sa mga guro para sa kanilang serbisyo sa halalan, nanindigan naman ang Chairman ng Senate Committee on Basic Education, Arts and Culture na ang pagbibigay ng buong halaga ng sahod at benepisyo ng mga guro ang pinakamagandang paraan upang pasalamatan sila sa kanilang serbisyo, lalo na't hinaharap nila ang patuloy na banta ng COVID-19.

Noong nakaraang Hunyo, iniulat ng Department of Education (DepEd) ang pag-apruba ng COMELEC sa panukalang dagdagan ng tatlong libong piso (P3,000) ang mga gurong magsisilbing poll worker at kasapi ng mga Electoral Board (EB). Panukala ng DepEd, siyam na libong piso (P9,000) ang magiging sahod ng mga Chairperson, walong libong piso (P8,000) ang magiging sahod ng mga miyembro ng EB, pitong libong piso (P7,000) sa DepEd Supervisor Official (DESO), at limang libong piso (P5,000) para sa Support Staff.

Ngunit nababahala ang COMELEC dahil sa halos apatnapung (37) porsyentong kaltas sa budget nito para sa 2022. Ayon sa Komisyon, maaapektuhan nito ang hiling ng mga gurong magkaroon ng dagdag na sahod para sa kanilang serbisyo sa halalan. Ayon pa sa COMELEC, iaapela nito sa Kongreso na maibalik ang mga items na inalis ng Department of Budget and Management (DBM).

Paliwanag ni Gatchalian, ang sahod at benepisyo ng mga guro ay pinapatawan ng income tax kung ang annual taxable income nila ay lagpas sa dalawang daan at limampung libong pisong (P250,000) threshold ng Tax Reform for Acceleration and Inclusion (TRAIN) Law. Para naman sa mga kumikita ng mababa sa dalawang daan at limampung libong pisong (P250,000), kinakailangan pa ang deklarasyon ng tax exemptions.
