Transcript of 'Kapihan sa Manila' press conference with Senator Mar Roxas, together with Iloilo Rep. Ferjenel Biron and Cavite Rep. Jun Abaya (excerpts)

On the Quality Affordable Medicines bill:

MAR: Sa wakas, palagay ko sa iilang linggo, ay maisasabatas na natin ito. Ang Senate at ang House version, palagay ko 80%-90% ng probisyon ay magkaparehas. There are a few items na nasa House na wala sa Senate, at palagay ko naman hindi malaki ang objection ng Senado sa mga bagay na ito. Halimbawa, sa pagrereseta ng mga doktor, may mga pag-amyenda ang House doon sa Generics Law, at bukas ang aming kaisipan dito. May must-carry provision ang House na sa palagay ko ay magandang probisyon. Bukas din kami dito. We are in general agreement with the thrust of the House version, and we expect that the bicam will be quite expeditious.

Biron: Sa sinabi ni Mar, 80%-90% ang pwedeng i-harmonize sa bersyon ng Senado at ng House. Nakikita na our objective judgment will focus on the difference of the regulatory mechanism.

MAR: Both the Senate and the House versions have a price regulatory mechanism. Ang pagkakaiba is that in the Senate version, ang aming pananaw ay rekta ang price regulation sa Secretary of Health at sa Pangulo. May transparency ito, may accountability, at may political mandate ang magre-regulate ng prices. Sa House version, gumagawa sila ng price regulatory board na naka-attach sa Department of Trade and Industry. The point is, it is a question of who will do it, rather than what will be done.

Ang konsepto ng Senado ay pairalin ang kompetisyon. Iyon ang una nating kasangkapan para ipababa natin ang singil ng gamot. Gayunpaman, doon sa Senate version, may probisyon na nagsasabi, upon the judgment of the Secretary of Health and recommended to the President, price regulation may be done. Open-ended ito. Ibig sabihin kung anong emergency natin, kung ano ang health emergency natin. We are not defining emergency in the way that it is a calamity kagaya ng bagyo o lindol. Health emergency can be simply a declaration of the state that says sobrang dami ang ating mamamayan na may karamdamang ganito, kaya sa aming judgment ay health concern ito, kaya papasok ang price regulation.

Abaya: I think there is a significant difference from what we have in other regulatory bodies, where a price is fixed for industry-wide use. In this instance, it will be very selective, and a cap will be there. Given that the House and Senate version have a regulatory scheme in place, there should also be a consideration for multinationals, that if they do not allow market forces to act accordingly, then government has the authority to intervene. Hindi maitutupad itong regulation, if market forces work.

MAR: Both versions promote competition, through amendments to the Intellectual Property Code, which we negotiated in Doha and Cancun when I was with the DTI. Nagsama-sama ang mga developing countries na maisulong na itong mga exemptions sa intellectual property regime, in the interest of health care. Sa TRIPS [Trade Related Intellectual Property System], nakasaad na each country can determine what is a health concern for them, hindi pantay-pantay ito. Dito sa atin, ang concern ay sa diabetes, 20 million, nearly one-fourth of our population have a diabetic or near-diabetic ailment.

Itong ni-negotiate namin sa Doha at Cancun, sabay kami ng counterpart ko sa Thailand na Trade Secretary. Doon sa kanila, napairal na nila ito, sinabi nila na hypertension ,high blood pressure is a health emergency, kaya nagkaroon sila ng compulsory licensing for hypertension medicines. Nagkaroon din sila ng parallel importation at semi-price regulation. Sa panahong ito, inaasahan na pagbalik ng sesyon ay maisasabatas na itong panukala.

Q: Will the proposed parallel importation be undertaken by the private sector?

MAR: The Senate version leans towards the government. Iyan ang aming bias, dahilan sa gusto nating makasiguro ang genuineness ng mga produktong ito. Yung mga private companies, maaari mag-import, but through the government, PITC [Philippine International Trading Corp.], para makasiguro tayo na genuine ang mga gamot na ito.

Q: On India's use of price regulation

MAR: I think that we can adopt many things from India, but not all things, because the conditions prevailing in India are not the same as those prevailing here. Kung tanggapin natin, kung ipasok natin dito expecting a simular result, baka mabigla tayo na hindi ganoon ang kinalabasan. Tama ang description ni Congressman Biron sa India, because in India, at that time up to the present, has a socialist government system. So therefore, the great bulk of purchases come from the government. Gobyerno mismo ang nag-uusap sa mga multinational companies. Ang price regulation ang naging mechanism for them to have that dynamic. Dito sa atin, hindi ganoon ang sistema. Ang sistema dito is more market-driven. That is the reality. Kung tignan natin ang purchases ng DoH, it is less than 10% of the entire market.

On SWS satisfaction rating survey of leaders and institutions:

Q: Are these ratings relevant to 2010?

MAR: Maganda na ang ating kababayan ay dapat talagang magkaroon ng tiwala sa ating gobyerno, at nasa sa gobyerno iyon na humakbang o umaksyon para ma-deserve nga nila ang trust rating mula sa ating mga kababayan.

Q: What's your assessment of the Senate's performance?

MAR: Palagay ko ang Senado could have done much more, lalung-lalo na in protecting the independence of the Senate. Itong malaking question mark sa executive privilege na hanggang sa ngayon ay hindi malinaw o walang sagot ay palagay ko isang malaking negative ito sa kalusugan ng ating demokrasya at sa magandang pagtrabaho ng ating mga institusyon dito sa ating demokrasya.

Palagay ko marami dapat isinagawa ang Senado para maprotektahan ang institutional integrity at institutional independence ng Senado. Kami sa Liberal Party, nilabanan namin ang isyu ng executive privilege sa Korte Suprema. Ang Senado, as an institution, lumaban against Executive Order 464, sa Presidential Proclamation 1017 at sa ibang mga paglalabis ng ehekutibo. Hindi natin nakita iyon itong nakaraang panahon.

On 2010 presidential elections:

Q: What is your reaction to Sen. Francis Pangilinan's statement that the Liberal Party has not chosen its standard bearer?

MAR: Tama si Senator Kiko, mayroong nakatakdang proseso ang Liberal Party, at lahat naman ay dadaan sa proseso na ito. Hindi naman ito korona na inaabot mula sa isa patungo sa iba. Ito'y isang malawak na pagpili ng lahat ng kasapi ng partido, at desisyon ito ng partido.

Q: So you're not the standard bearer?

MAR: Wala namang nagsasabi. I'm the elected president of the party, and that is what my election was.

Abaya: When we elected Mar Roxas as our president, that was our activity [LP election] Natapos na ang termino ni Franklin Drilon, at hinalal natin si Senator Roxas. Hindi pa naumpisahan ang actual process of determining kung sino ang actual candidate ng partido. However, kung pakinggan niyo ang karamihan ng mga miyembro, halos makikita natin kung sino talaga ang ninanais. As to the process itself, wala pang naumpisahan. Being the standard bearer is open to all who have the capability to lead not just our party but the nation and offer good alternatives for 2010 and beyond.

Q: What are the chances of the LP President becoming the standard bearer?

Abaya: For 2010, malaking-malaki. Hindi lang personal ko, nakikita niyo how media is covering it, all the actions, all the messages - oras na para bigyang pag-asa an ating bayan.

Q: On talks of Sen. Francis Escudero being eyed as running mate for 2010

MAR: Siguro iyon ang analysis nila. Ang ating pinagbibigyang atensyon ng buhos ng pagsikap ay yung pagtanggal ng VAT mula sa produktong petrolyo. This is savings of P4/liter for diesel, P65 savings bawat tangke ng LPG. Ito'y malaking dagok sa ating mga kababayan at pati na rin sa ating ekonomiya. Magkukulang ang domestic purchasing power, at ang prinsipyo dito ay: sino ang dapat gumastos nitong pera, si Juan de la Cruz, na kumitang nitong pera, o yung gobyerno na nagpataw nitong buwis? Si Juan de la Cruz ang dapat gumastos ng pera niya, lalung-lalo na sa ngayon na hindi pangkaraniwan ang panahon.

Q: Who would you coalesce with for 2010?

MAR: Ang concentration namin sa LP ay papaano natin tatanggalin ang VAT mula sa produktong petrolyo. Makikipag-coalesce kami sa iba't ibang mga NGOs at political parties at personalities at sa lahat para tulungan ating mga kababayan.

Q: Does the LP have the capability to launch a presidential campaign?

Ito ang sinusulong ng Partido Liberal, ito ang aming programa de gobyerno, dito kami tatayo.

Q: Are you open to charter change with regard to elections?

MAR: On charter change, hindi pa panahon ito, hindi ito ang sagot sa problema natin ngayon, at magsisilbing distraksyon lang ito sa ating bansa.
