MANIFESTATION OF SENATOR TEOFISTO "TG" GUINGONA III

Para po maintindihan ng mga kababayan natin. Marami pong mga kababayan natin ngayon ang nangangamba, at kasama na po ako dun.

Nangangamba na magkakaroon po ng constitutional crisis. Ano po ang basis ko sa pagsabi nito? Ngayon po ay may pending petition sa Supreme Court na pigilan ang paglabas ng subpoena mula sa Impeachment Court na may kaugnayan sa bank deposits ng nasasakdal. Subalit karapatan naman po yun ng defense. Gayunpaman, nangangamba pa rin po ako. Ngayon pong hapong ito, mayroon po akong 3 mahahalagang punto:

First, the impeachment process is the people's way of making public officials accountable. The people through the Constitution reposed this power to Congress. Therefore, the Senate, as an Impeachment Court, is independent.

Second, since the Impeachment Court is independent and a class of its own, the Supreme Court should not impose its will on this body. Because at this point, we are not a co-equal branch of government. We are co-equal bodies if we are legislating. But at this point, we are not legislating. We are exercising a judicial function as an Impeachment Court. Sana po makita ng Korte Suprema ang puntong ito.

Third, Senate as an Impeachment Court has the sole power to try and decide on impeachment cases. Uulitin ko po ang dati ko nang sinabi. Nandito po kami hindi lamang bilang senador. Kami po ay nandito bilang senator-judges. Narito po kami para dinggin ang isang kaso at para gumawa ng pasya tungkol sa nasasakdal.

Pero, may tiwala pa rin ako sa Korte Suprema, na alam nito ang tamang dapat gawin at tutulungan tayo ng Korte Suprema sa paghahanap ng katotohanan.
