Anthony Taberna (AT): ... Sino ang inaasahang ihaharap na hostile witness ng depensa...?

ASC: Ayon doon sa hiningi ni Atty. Roy na yung mga nag-complain sa Ombudsman ay inisyuhan na ng subpoena pati ang Ombudsman mismo pero siguro yung pinaka-mahalaga dito ay yung pag-balanse talaga ng issue na ang isa pang sitting Supreme Court Justice lalo na ang Chief Justice ay pwedeng kasuhan o pwedeng imbestigahan ng Ombudsman.

Kasi ako mismo, sinuportahan ko ang pagkakaroon nitong impeachment trial dahil ito lang ang paraan para i-hold accountable ang isang Supreme Court Justice. Pero kung sasabihin natin na pwede pala namang kasuhan sa Ombudsman, eh ngayon naka 180 hours na tayo more or less (total sa Impeachment Trial hours).

Ito ang isang isyu na sinasabi mismo ni Atty. Roy na kaya gusto ni Supreme Court Chief Justice Corona na harapin ang Impeachment Court ay kasi mas gusto daw niyang yung mga accusers niya ang makaharap niya sa impeachment court imbis na sa office of the Ombudsman pa.

At least nabigyan ng tamang pagtingin ang impeachment court, tama yung venue at tama yung legal process. But it will still be a big issue whether or not the Office of the Ombudsman can investigate and prosecute because what if there are other pending cases? Can these be heard in the Office of the Ombudsman and investigated when these concern other sitting Supreme Court Justices?

Bagamat lihis ng konti ito sa impeachment, ay malaking issue ito sa independence ng judiciary vis-à-vis sa anti-graft move ng gobyerno.

AT: So hindi po pala ma-coconfine sa 10 million dollar account di umano ni Chief Justice Corona ang tanungan dito?

ASC: Tingin ko masyadong mabigat ang isyu para sa ating bansa at sa ating kinabukasan para lang i-confine ito doon lamang sa 10 million dollar issue. Although recently, that became the focus.

Bernadette Sembrano (BS): Tatanggapin ba siya as a witness, I mean ganun lang ba kadali ang pagtanggap bilang witness dito kay Ombudsman gayong wala nga sa articles of impeachment...?

ASC: Well, iyon po ang tema ni Atty. Roy na kung interesado ang impeachment court kahit hindi ito kasama, pero malinaw na sa Article 2 ang pinag-uusapang SALN, at malinaw na kung meron kang pera na hindi mo sinama sa SALN, kasama dapat ito (sa impeachment case).

Ang nagiging isyu, bakit napasama ang Ombudsman? Meron ba syang ebidensya na hindi hawak ng Impeachment court?

If you want to be strict about it, the relevance is - the relevance of the testimony of our respected Ombudsman is if "meron ka bang hawak tungkol sa dollar account na hindi namin alam". But the issue that is very important in democracy is whether or not a sitting Ombudsman can investigate (and thereafter prosecute an impeachable officer).

People seeking justice can go anywhere, but the question is - what is the proper procedure? Should the Office of the Ombudsman put it on vote and say that while these accused impeachable officials are in position they cannot be investigated? Or the other more progressive stance will say they can be investigated but not bring the case in court yet (while they are in position)? So I don't know the answer to that but we may ask that to the Ombudsman later this afternoon.

AT: Senator, doon po sa pagpapalit ng strategy nung depensa na ngayon po ay handa na nilang iharap si Chief Justice Corona, ano po ang nakikita ninyo doon bilang isang hurado?

ASC: Bilang isang abogado muna ha. Alam mo noong una, gustung-gusto kong sumagot na yung depensa, kasi pag panay yung prosecution, syempre nabubuo na yung paniwala sa ating mamamayan. They were good lawyers by being very patient in waiting for all the accusations be laid down (by the prosecution) before they speak. Yun talaga ang advice pag hindi public yung trial, pagka hindi ito public official halimbawa.

Pero syempre kapag public official gusto mong magsalita kaagad. Talagang privilege yan na nasa abogado nila iyon kung gusto nilang iharap o hindi pero dahil public official ka, ever since even way back in the House of Representatives when I pushed for the impeachment (of GMA), ang sabi ko iba kapag private, iba kapag public.

Kasi sa private, kung kaso mo iyon, walang pakialam ang publiko, pwede kang magsalita pwedeng hindi. Pero kapag public, kahit may legal right ka na huwag magsalita, isyu pa rin kung may tiwala pa ba sayo ang tao. Would you still fit to hold that office.

AT: Ito po ang huling tanong namin, makabubuti po ba kay chief justice Corona yung humarap siya, baka talupan siya ng buhay ika nga sa impeachment court.

ASC: Pagkaintindi ko sa mga kapwa nating Pilipino, gusto nila nakikita sa mata ang tao nagpapaliwanag, at kung totoong hindi (guilty), mapapaniwalaan nila. Pero kapag hindi siya humarap, yung iba may konklusyon na agad. Ang ma-aassure lang namin sa publiko, we will give the Chief Justice all due respect and hopefully all other Senator Judges will focus on the issue. Walang personalan.
