SEN. GRACE POE'S AMBUSH INTERVIEW TRANSCRIPT

Question: Bakit pa kailangan mag-hear ng FOI ay may EO na?

Sen. Grace Poe: Kasi, bagamat nagpapasalamat tayo, yung EO, hindi kasama dun yung Kongreso, di kasama ang Judiciary at maraming iba't ibang ahensya na dapat ay maisama sa Freedom of Information.

Q: On having apprehensions on the exceptions?

Poe: So sinabi natin na imbis na pintasan natin ang exemptions, hinihingi ko sa bawat resource person yung maaaring sabihin na apprehensions ukol sa specfic exemptions. Kasi 166 nga iyon. May mga iba naman doon na legitimate exemptions pero may mga iba din na sa tingin ko ay hindi naman natin kailangan isama pa. Kaya nga kailangan ding pag-aralang mabuti itong mga exemptions na ito kasi we have to make specific mentions of it in the new law so that it will override the executive order.

Q: Mayroon bang mga exceptions na dapat wala doon pero..?

Poe: Well, unang-una doon sa executive order, wala yung mga SALN namin, diba? So importante na talagang masama iyon.

Q: What about the problem not just on the access but the usability?

Poe: That's right. Kahit na may Freedom of Information, kung napakahirap naman ng format nito--ibig sabihin, tatambakan ka nag impormasyon na hindi naman importante, so balewala rin. Sa usability, automatic uploading sa website in a format that is technologically relevant kasi you have to keep updating your system. Noon, usong-uso ang mga PDF file, ngayon hindi na ganoon. Word na. So we have to keep up with the times to make sure that access to information is easy.

Q: On declassification: Ano yung tinitingnan natin na timeframe?

Poe: Depende siguro. Kapag national security, mayroong a few years. It cannot be determined...It will depend on what time of information will be declassified. But certainly, I think that the important provision here is ang Freedom of Information exceptions cannot be used to cover a wrongdoing. Palagi naming sinasabi--kung ang dahilan ay pagtakpan ang isang mali, hindi pwedeng gamitin ang Freedom of Information.

Q: Ma'am how soon can we pass the FOI?

Poe: Sana mag-third reading na tayo before we go on break on December.

Q: Posible po ba iyon?

Poe: Maraming trabaho ngayon ang Senado basta naman makakuha tayo ng quorum palagi at oras sa floor, bakit naman hindi.
