Purveyors of 'fake news' should be jailed, fined - Jinggoy

TO discourage people from spreading "fake news," Senator Jinggoy Ejercito Estrada is pushing for the criminalization of act of spreading false or misleading news online.

"Click baits, propaganda, and manipulation of legitimate news segments to deliberately online falsehoods, false news or disinformation are so common nowadays, making it difficult to distinguish which is actual news to fake ones. Masyado ng talamak ang mga ito," Estrada said.

In introducing Senate Bill No. 1296, the senator said the legislative measure hopes to put to stop the proliferation of disinformation and misinformation on the internet by criminalizing fake news as a cybercrime under Republic Act No. 10175, otherwise known as the Cybercrime Prevention Act of 2012.

Estrada proposed an amendment to Section 3 of RA 10175, to include "fake news" in the definition of terms and its inclusion in Section 4 on the list of cybercrime offenses.

In his proposed SBN 1296, "fake news refers to misinformation and disinformation of stories, facts, and news which is presented as a fact, the veracity of which cannot be confirmed, with the purpose of distorting the truth and misleading its audience."

As an offense, Estrada's bill said the "creation and dissemination of fake news committed through a computer system or any other similar means which may be devised in the future."

Even surveys showed that the majority of Filipinos already find it difficult to spot fake news on television, radio, and social media, the senator said, citing the results of the Social Weather Stations (SWS) conducted in December 2021 and released in February this year

In the SWS survey, it showed that 70% or seven out of 10 adult Filipinos said that the problem of fake news and its spread on the internet is serious.

PARA matigil ang patuloy na pagkalat ng mga "fake news," isinusulong ni Senator Jinggoy Ejercito Estrada na gawing krimen ang pagpapalaganap ng mga mali o mapanlinlang na balita online.

"Ang mga click baits, propaganda at pagmamanipula ng mga lehitimong news segments para makapagpalaganap ng kasinungalingan, maling balita o disinformation ay pangkaraniwan na ngayon kaya mahirap na matukoy kung alin ang totoo sa mga pekeng balita. Masyado ng talamak ang mga ito," ani Estrada.

Sa paghahain ng Senate Bill No. 1296, sinabi ng senador na layon ng kanyang panukala na masugpo ang paglaganap ng disinformation at maling impormasyon sa internet sa pamamagitan ng pagsama nito sa mga itinuturing na krimen o cybercrime sa ilalim ng Republic Act No. 10175 o ang Cybercrime Prevention Act of 2012.

Iminungkahi ni Estrada ang pag amyenda sa Section 3 ng RA 10175 para isali ang "fake news" sa depinisyon ng mga termino at pagsama nito sa Section 4 o ang listahan ng cybercrime offenses.

Sa kanyang SBN 1296, ang fake news o pekeng balita ay tumutukoy sa maling impormasyon at disinformation ng mga kuwento, katotohanan at balita at palabasin ito bilang isang katotohanan ngunit hindi maberipika o makumpirma kung totoo. Maaari rin na ang layunin nito ay baluktutin ang katotohanan at iligaw ang mga taga-pakinig nito.

Krimen na maituturing, ani Estrada sa kanyang panukalang batas, ang paglikha at pagpapakalat ng pekeng balita na ginawa sa pamamagitan ng isang computer system o iba pang katulad na paraan na magagamit sa hinaharap.

Maging ang mga surveys ay nagpapakita na karamihan sa mga Pilipino ay nahihirapan na makilala ang pagkakaiba ng fake news sa telebisyon, radyo at social media, sabi pa ng senador. Binanggit nya ang lumabas na survey na ginawa ng Social Weather Stations (SWS) noong Disyembre 2021 at inilabas ng Pebrero ng taong kasalukuyan.

Sa nasabing SWS survey, lumabas na 70% o pito sa sampung Pilipinong nasa tamang edad na ang nagsabing malubha na ang problema sa fake news pati na ang paglipana nito sa internet.
